Abstract The Impact of Qiyas Deductive Analogy in Deriving Contemporary New Jurisprudential Rulings Applied Fundamental Contemporary Study on International Islamic Fiqh Academy Decisions By Monera Ali Saleh Al-manahi Supervised by professor: Ahmad Mohamed Azb Qiyas is considered one of the important tools which used by mujtahads in each contemporary nawazil. Since the International Islamic Fiqh Academy studies these contemporary nawazil, this dissertation sough after the impact of Qiyas to interence these contemporary nawazil on the International Islamic Fiqh Academys resolutions, starting from its second session to its twenty-two session. This study used an applied theorized method. The first section consists of Qiyas definition, reasoning, constituents and each constituents conditions, divisions, and argument all in five chapters. Then the study of these contemporary nawazil in sex chapters. The first section ends with the resolutions and methods of International Islamic Fiqh Academy in studying contemporary nawazil. This is the theoretical section of the dissertation. The second section which is applied, the researcher used inductive deductive comparative method. The inductive method used for collecting the data by reading the researches to examine carefully the entire resolutions of the International Islamic Fiqh Academy, seeking after selecting the contemporary nawazil which based heavily on qiyas. Then the researcher studied them comparatively according to the four prominent juristic schools. All of these in five chapters as following; the impact of qiyas in inference for contemporary nawazil in acts of worship, transactions, punishments, foods, drinks, and finally medical issues. The result shows that qiyas is considered the source of renewing Islamic Fiqh, which reflected obviously on the International Islamic Fiqh Academys resolutions, where qiyas influenced noticeably in the inferencing contemporary nawazil cases in different juristic chapters. |
