Praise be to Allah, The Lord of the Worlds Prayer and peace be upon Muhammad and all his Family and Companions.
This research aims at revealing the secrets of the Islamic legislation through its purpose to safeguard ethics, and proving this purpose through the Retributive Justice in respect of which large-scale concerns have arisen out, and wrongly accused Islam of adopting cruelty and brutality by enforcing this punishment.
This research is divided into an introduction and two sections; the first of which is theoretical and meaningful, which addresses the morality, its purpose and the characteristics of moral obligations in Islam, the definition of Sharia aims and their divisions, the relationship between the ethics and the Sharia aims, proving the Sharia aim to establish noble morality as expressed in the verses of the Holly Qur'an and the Prophet Sunnah by the induction course. The second section is of an applied nature, aiming to reveal the purpose of safeguarding morality underlying the Retributive Justice. It includes a definition of crime and its divisions, the punishment and its types, retribution punishment and evidence of its legitimacy. It then tackles the ethical dimensions of retributive justice in the soul through the conditions of its necessity, and requirements of its fulfillment, the rules to be taken into due consideration when enforcing it. Next, it addresses the safeguarding of morality through the Retributive Justice away from the soul through the requirements of its fulfillment, the way and timing of its enforcement, and then sheds light on the factors which abate the Retributive Justice to reveal the ethical aspects; e.g. pardon and reconciliation.
In the theoretic part, the research's methodology is based on analysis and deduction, while in the applied part; it adopts the inductive approach, which follows up the matters and issues in which it shows the safeguarding of ethical aspect.
Among the most important findings of the research is that the overriding characteristic of ethical obligation in Islam is taking the possibility into due consideration upon enacting the legislation and facilitation at time of enforcement, and that safeguarding morality is a comprehensive purpose, the first way to prove it is the moral induction.
Foremost of the recommendations concluded by the research is to attach importance to the practical aspect of morals, try to inculcate them in the minds of Muslims, maximize the cognitive production on its subject, and try to combine the jurisprudential issues to the morals they address; to be consolidated further in the souls. |
